Each text message sent to or received by a service subscriber of any wireless carrier will incur a standard messaging charge, in accordance with that carrier's Terms and Conditions applicable to such customer's particular voice/data rate plan and a premium text messaging charge. 1. Acceptance of Official Rules. By entering the CBS Gameshow Marathon Home Viewer Giveaway ("Sweepstakes") by text message and/or the CBS.com Web site accessible at the domain "cbs.com" (the "CBS.com Service"), you hereby accept and agree to these official rules (the "Official Rules") of this Sweepstakes, and the decisions of the Administrator whose decisions are final and binding on all matters relating to the operation of this Sweepstakes.
2. Eligibility. This Sweepstakes is offered and open to persons who are legal residents of the forty-eight (48) contiguous United States or Washington D.C. at least twenty-one (21) years of age or older at the date of entry in this Sweepstakes. To enter online, an eligible person must first become a Registered User of a CBS Service (Web sites defined below). For purposes of these Official Rules "Registered User(s)" means a person who has successfully completed the registration form and has obtained a User Identification ("ID") and associated password ("Password") on one or more of the following Web sites: CBS.com, CBSnews.com, CBS SportsLine.com, ncaasports.com, NFL.com, upn.com, SuperBowl.com and/or pgatour.com. If you are not a Registered User you may become a CBS.com Registered User and obtain an ID and Password by completing the CBS.com Service registration form by going to www.cbs.com on the CBS.com Service. There is no fee or charge to you to become a Registered User of any of the sites noted. You do not need to become a Registered User of a CBS Web site to enter the Sweepstakes via the text message method of entry. Employees, officers, directors (including immediate family members and members of the same household) of the Sweepstakes Entities, their parents, affiliated and subsidiary companies, advertising and promotion agencies, legal and financial advisors and any and all other companies associated with this Sweepstakes are not eligible to participate in this Sweepstakes. For purpose of the foregoing "immediate family" means parents, spouses, children, step-children, siblings or any members of the same households of such employees and directors. This Sweepstakes is void outside of the contiguous U.S., including Alaska, Hawaii, Puerto Rico, all US territories and possessions and where prohibited by law.
3. Promotion Period/Episode Entry Periods: The Sweepstakes begins on May 31, 2006 at 8:00:00 PM Eastern Time (ET) and ends at 11:59:59 PM Pacific Time on June 29, 2006 (the "Promotion Period"). Episode Entry Period: On Gameshow Marathon broadcast nights, entries will be accepted between the Eastern Time broadcast start of each first-run episode of Gameshow Marathon scheduled at 8:00 PM Eastern Time until 11:59:59 PM Pacific Time. This period of time is defined as the "Episode Entry Period". Gameshow Marathon broadcasts are subject to preemption and schedule changes. If such changes occur they will be posted online at www.cbs.com/gameshowmarathon. Also check local television listings for broadcast dates/times in your area.
4. Sweepstakes Description: During each first-run episode of Gameshow Marathon broadcast during the Promotion Period (each, an "Episode") a single Gameshow Marathon Home Viewer Giveaway trivia question will be asked. Three possible answers will be provided. The announcer will invite home viewers to enter the Sweepstakes by submitting their answer to the trivia question via either text message on their text messaging capable cell phone or online as described herein. For each correct answer submitted via either entry method an entrant will receive one (1) entry into the prize drawing for the corresponding Episode Entry Period. There is a maximum of 20 entries per person per Episode Entry Period of which ONLY 10 entries can be submitted via text message. Incorrect answers to trivia question will not qualify for entry. All eligible entries will be placed into a random drawing to select one potential Grand Prize winner ("Winner") per Episode. The home player Winner (pending confirmation of eligibility) will win the prize(s) won by the celebrity guest winner for the corresponding Episode plus a Harrah's VIP vacation package ("Harrah's VIP Vacation Package") (with the exception of the final episode where a Harrah's VIP Vacation Package will not be offered)(each collectively a "Grand Prize").
5. How to Enter: There are two ways to enter:
1) Via Text Messaging: If you are a wireless service subscriber and have a text messaging capable device, you may enter the Sweepstakes during each Episode Entry Period by sending a text message to the short code "22788" (CBSTV) with your answer to the corresponding Episode's trivia question (select answer choice #1, #2 or #3). By accepting the double opt-in (if your carrier requires a double opt-in for premium text messages) and timely responding to the opt-in with the correct answer to the trivia question, you will be entered one time into the Sweepstakes for the corresponding Episode Entry Period. You will be charged for each text message sent or received from your handset according to the Terms and Conditions of your Service Agreement with your wireless carrier plus a premium text messaging charge ($.99 each). Standard text and data rates may apply. Each wireless carrier's rate plan may vary, and entrants should contact their wireless carrier for information on messaging rate plans and charges relating to your participation in this Sweepstakes. Any text message form of entry into this Sweepstakes will be deemed made by the named account holder whose mobile phone number is assigned at the time of entry to the text messaging device so used.
2) Online: To enter this Sweepstakes online, go to www.cbs.com/gameshowmarathon and follow the instructions to complete the Sweepstakes entry form, including, without limitation, submitting your ID and Password, selecting your trivia question answer, hitting submit and, if you provided the correct answer, you will receive one (1) entry into the Sweepstakes drawing for the corresponding Episode Entry Period. If you are not a Registered User see rule #2 above for instructions on how to become a Registered User. There is no fee or charge to you to become a Registered User.
For every correct answer submitted via text messaging or online entrant will receive one (1) entry into the corresponding Episode Entry Period Grand Prize random drawing. Only the correct answer to the trivia question will be eligible for the corresponding Episode Entry Period Grand Prize drawing. Sponsors retain sole discretion for determining correct answers to trivia questions. Limit 20 entries per e-mail address and/or cell phone number per Episode Entry Period, with a maximum of 10 entries via text message. Any attempt by any person to enter in excess of the disclosed entry limit will void excess entries from any prize consideration in connection with this Sweepstakes.
6. Prizes: Seven (7) Grand Prizes will be awarded. There is one (1) Grand Prize per new Episode of the Gameshow Marathon. Each Grand Prize consists of the prize(s) won by the celebrity grand prize winner on the corresponding Episode (the "On-Air Prize(s)") plus a Harrah's VIP Vacation Package with the exception of Episode 7 where a Harrah's Vacation Package will not be offered. The estimated total retail values for the prizes (not including Harrah's VIP Vacation Package) by Episode are as follows: Episode 1-$54,366; Episode 2-$50,999; Episode 3-$67,603; Episode 4-$46,267; Episode 5-$50,445; Episode 6-$50,000; Episode 7-$50,000. Episode sequence may vary at sole discretion of Sponsors. Each Winner will be provided a full description of the prize(s) won including any special instructions regarding acceptance of a particular type of prize. For example, if an automobile is part of a prize package, the Winner would be required to provide proof of automobile insurance and agree to pay license and registration fees etc., prior to receipt of vehicle.
Winners for Episodes 1-6 only will receive (in addition to their On-Air Prize(s)) a Harrah's VIP Vacation Package that consists of round-trip coach air transportation from a single major U.S. airport nearest Winner's home (as determined by Sponsors in their sole discretion) in the 48 contiguous United States/D.C. to the Harrah's resort destination specified by Sponsors, double occupancy standard hotel accommodations for 3 nights, and amenities, such as dinners and show tickets to be determined solely by Sponsors. Winners must be available to travel on dates and on the flights specified by Sponsors or forfeit the Harrah's portion of the Grand Prize. Approximate retail value of each portion of the Grand Prize consisting only of the Harrah's VIP Vacation Package is $2,820. Actual value of Harrah's Vacation Package may vary depending upon the point of departure. If Winner lives within a 100-mile radius of a Harrah's resort, ground transportation may be provided in lieu of air transportation and no compensation or substitution will be provided for difference in prize value. Certain travel restrictions may apply.
Guests of travel prize Winners must be legal residents of the 48 contiguous United States or Washington, D.C., 21 years of age or older and must travel together on the dates selected by Sponsors and on the same itinerary, or the travel portion of any prize will be forfeited. Travel arrangements must be made through Sponsors' travel agent, on a flight and carrier of Sponsor's choice. It is the responsibility of the Winner and his or her travel companion to arrive at the designated airport in time for their flights, with proper travel documentation. Certain travel and security restrictions may apply to travel generally and to the winner and his or her travel companion specifically. It is the responsibility of the Winner and his or her travel companion to comply with all travel, security and other laws, regulations, airline passenger, hotel and other rules that may apply to them. In addition, the Winner and his or her travel companion are responsible for obtaining travel documents, e.g. acceptable photo ID, Passport, Visas etc. All other expenses relating to acceptance of any Grand Prize not explicitly stated herein, including but not limited to taxes, meals, beverages, alcoholic beverages and gratuities are the responsibility of Winners and guests. Certain travel restrictions may apply. Specifics of Grand Prize travel package(s) are subject to availability. Limit one Grand Prize per household for Promotion Period. Total approximate retail value of all prizes is $386,600.
By entering the Sweepstakes entrants agree that if selected and verified as a Winner, Sponsors (or designee of Sponsors) shall have the right, in their sole discretion, to record (audio/visual), film, photograph, broadcast, and exploit in any manner in all media, throughout the universe, in perpetuity, the delivery of stand-in prize(s) to each Winner (including, without limitation, a Winner's home address, name, appearance, voice, statements, likeness, and biographical information). Stand-in prizes will be used for taping purposes only. Winners will not be allowed to retain stand-in prizes. Actual prize(s) (except for vacation prizes) will be delivered to the Winner's home within 90 days of the initial broadcast of the Episode of the Gameshow Marathon in which the On-Air Prize(s) appear.
Each Winner must agree to be available to attend a taping of arrival of stand-in prize(s) within 1-4 days of notification of Winner status, pending verification of eligibility and compliance with these Official Rules. Date, time and place of taping are at sole discretion of Sponsors. Sponsors objective is to record (audio/visual) arrival of stand-in prize(s) at the Winner's residence in the contiguous 48 United States or Washington, D.C.; or another location selected by Sponsors within a 40 mile radius (approximate) of Winner's residence. If the Winner does not agree to participate in the taping, Sponsors retain the option to disqualify the entrant and select an alternate potential Winner.
7. Prize Drawings/Winner Notification: For each of the seven (7) Gameshow Marathon Episodes broadcast during the Promotion Period, one (1) Winner will be randomly selected from all eligible entries received during the corresponding Episode Entry Period. On the day following the initial broadcast of each new Episode of Gameshow Marathon a random drawing will be conducted from among all eligible entries received during the corresponding Episode Entry Period to select a potential Winner subject to verification of eligibility and compliance with these Official Rules. Each drawing will be completed on or about 10:00 AM ET on the day following broadcast of the corresponding Episode. A representative of Marden-Kane ("Administrator") will attempt to contact the Winner personally via the cell phone number or daytime phone number (provided on online entry form) between 10:00 AM ET and 5:00 PM ET on day of drawing. If unable to reach any Winner after one call attempt, the agent of Sponsors retains sole discretion to disqualify the entry and will attempt to contact an alternate potential Winner entrant until such time that direct contact is made with a potential Winner. No voicemail or answering machine messages will be left. All drawings will be conducted under the supervision of Marden-Kane Inc., an independent judging organization whose decisions are final and binding on matters relating to this Sweepstakes. Eligible entries from any Episode Entry Period will not "roll-over" into any subsequent Episode Entry Periods. Odds of winning a prize depend on the number of eligible entries received for the applicable Episode Entry Period.
8. Affidavit of Eligibility/Liability Release and Publicity Release ("Release Forms"). Each potential Winner will be required to sign and properly execute (including notarization) the following documents and return them via facsimile (and subsequently by mail) to Administrator within 12 hours of receipt: (1) an Affidavit of Eligibility and Liability Waiver; (2) where lawful, a consent to publicity. If any documents sent to a potential Winner by any means are returned as undeliverable or if a potential Winner fails to properly execute and return all documents described herein in the time noted, or if potential Winner is found not to be eligible or not in compliance with these Official Rules the Prize will be forfeited and an alternate potential Winner will be selected and contacted in accordance with these Official Rules.
9. Certain Prize Restrictions. No assignment, transfer, conversion to cash or cash redemption or substitution of any portion of a prize is permitted, except Sponsors reserve the right to substitute any portion of a prize with a prize of comparable or greater value should any portion of a prize become unavailable. Prizes are solely for personal use and may not be used in conjunction with any other promotion. Sweepstakes Entities, and/or any other relevant party, reserve the right, in its sole discretion, to remove or to deny entry to any Winner who engages in non-sportsmanlike behavior or acts in a disruptive manner or with the intent to annoy, abuse, threaten or harass any person.
10. Prize Taxes. All federal, state or other tax liabilities arising from this Sweepstakes, is the sole responsibility of each Winner.
11. Publicity Release Terms. Except where prohibited by law, Winner's acceptance of any prize(s) constitutes permission for the Sweepstakes Entities to use Winner's name, photograph, video, film, likeness, statements, biographical information, name, voice, and address (city and state) worldwide and in all forms of media, in perpetuity, without further compensation, except where prohibited by law.
12. Improper Conduct. Sponsors in their sole discretion, may disqualify any entrant from participation in the use of any or all portions of this Sweepstakes, and refuse to award any prize(s), if entrant engages in any conduct Administrator deems to be improper, unfair or otherwise adverse to the operation of the Sweepstakes or detrimental to other entrants of the Sweepstakes. Such improper conduct, includes, without limitation, falsifying personal information required during entrant registration or prize claim, violating any term or condition stated herein, accumulating entries through methods such as automated computer scripts or any other programming techniques, allowing others to use entrant's personal information for the purpose of accumulating entries, or intentionally trying to defraud, reverse engineer, disassemble or otherwise tamper with the computer programs in connection with this Sweepstakes. Entrants agree that the Sponsors may void any part of any prize(s) that entrant may have won and/or require the return of any part of a prize(s) that entrant may have won as a result of such improper conduct. Entrant further acknowledges that any forfeiture of any prize(s) and/or return of any prize(s) shall in no way prevent Sponsors from pursuing other avenues of recourse such as criminal or civil proceedings in connection with such conduct. WARNING: ANY ATTEMPT TO DELIBERATELY DAMAGE OR UNDERMINE THE LEGITIMATE OPERATION OF THIS SWEEPSTAKES MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, THE SWEEPSTAKES ENTITIES RESERVE THE RIGHT TO SEEK DAMAGES OR OTHER REMEDIES FROM ANY SUCH PERSON(S) RESPONSIBLE FOR SUCH ATTEMPT TO THE FULLEST EXTENT PERMITTED BY LAW.
13. Integrity of Sweepstakes. If, for any reason, the Sweepstakes is not capable of running as planned by reason of infection by computer virus, worms, bugs, tampering, unauthorized intervention, fraud, technical failures, network overload (Internet/phone/cellular) or any other causes which Administrator, in the sole opinion of Administrator, deems could corrupt or affect the administration, security, fairness, integrity or proper conduct of this Sweepstakes, Sponsors reserve the right in their sole discretion to cancel, terminate, modify or suspend this Sweepstakes and select an alternate potential Winner for the affected Episode Entry Period from entries received prior to the action taken or in such other manner as Sponsors may deem fair and appropriate.
14. Lost, Delayed or Corrupted Entries. The Sweepstakes Entities assume no liability and are not responsible for, and each entrant hereby forever waives any rights to any claim which may arise in connection with this Sweepstakes as a result of or relating to any lost, late, incomplete, corrupted, stolen, misdirected, delayed entries; or any computer, telephone, wireless phone, cable, network, satellite, electronic or Internet hardware or software malfunctions, unauthorized human intervention, or the incorrect or inaccurate capture of entry or other information, or the failure to capture any such information. In addition the Sweepstakes Entities are not responsible for any incorrect or inaccurate information, whether caused by end users of the CBS.com Service, tampering, hacking, or by any of the equipment or programming associated with or utilized in this Sweepstakes and assume no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to the Sweepstakes.
15. Damaged Property. Sweepstakes Entities assume no liability and are not responsible for, and each entrant hereby forever waives any rights to any claim which may arise as a result of any injury or damage to entrants' or to any other person's computer or property related to or resulting from participating in this Sweepstakes or downloading materials from this Sweepstakes.
16. Sweepstakes Errors. The Sweepstakes Entities assume no liability and are not responsible for, and each entrant hereby forever waives any rights to any claim in connection with, errors and/or ambiguity: (a) in the Sweepstakes; (b) in any related advertising or promotions of this Sweepstakes; and/or (c) in these Official Rules. In the event of any ambiguity(s) or error(s) in these Official Rules, Sponsors reserve the right to modify these Official Rules for clarification purposes or to correct any such error(s) without materially affecting the terms and conditions of the Sweepstakes.
17. Prize Winners and Prizes. The Sweepstakes Entities assume no liability and are not responsible for, and each entrant hereby forever waive any rights to any claim in connection with, the selection and announcement of a Winner, or the distribution of a prize, the acceptance/possession and/or use/misuse of any part any prize(s) and/or any injury or damage to entrant's or third person's property related to or resulting from any part of any prize(s) or any part of this Sweepstakes.
18. Release and Indemnity. Each entrant in this Sweepstakes, including, without limitation, each Winner, hereby forever releases and agrees to hold harmless the Sweepstakes Entities and their parents, affiliates, subsidiaries, advertising and promotion agencies and their respective directors, officers, employees, representatives and agents harmless from any and all liability for any injuries, loss or damage of any kind to person, including death, and property, arising in whole or in part, directly or indirectly, from acceptance, possession, use or misuse of any prize, participation in this Sweepstakes and participation in any activity related (directly or indirectly) to this Sweepstakes.
19. Limitation of Liability. IN NO EVENT WILL THE SWEEPSTAKES ENTITIES, THEIR PARENTS, AFFILIATES, SUBSIDIARIES AND RELATED COMPANIES, THEIR ADVERTISING OR PROMOTION AGENCIES OR THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, REPRESENTATIVES AND AGENTS, BE RESPONSIBLE OR LIABLE FOR ANY DAMAGES OR LOSSES OF ANY KIND, INCLUDING DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES ARISING OUT OF, IN CONNECTION WITH, OR INCURRED BECAUSE OF YOUR PARTICIPATION IN THE SWEEPSTAKES OR THE DOWNLOADING FROM AND/OR PRINTING MATERIAL DOWNLOADED FROM WEBSITES ASSOCIATED WITH THE SWEEPSTAKES. SOME JURISDICTIONS MAY NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES OR EXCLUSION OF IMPLIED WARRANTIES. THEREFORE, SOME OF THE ABOVE LIMITATIONS OR EXCLUSIONS MAY NOT APPLY TO YOU. CHECK YOUR LOCAL LAWS FOR ANY RESTRICTIONS OR LIMITATIONS REGARDING THESE IMITATIONS OR EXCLUSIONS.
20. Disclaimer of Warranties. THE SWEEPSTAKES AND PRIZES ARE PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT.
21. Identity Disputes. In the event of a dispute as to the identity of a Winner based on an e-mail address or cellular phone number, the winning entry will be declared made by the Authorized Account Holder of the e-mail address and/or cellular phone number submitted at time of entry. For purposes of these Official Rules "Authorized Account Holder" is defined as the natural person who is assigned to an e-mail address and/or cellular phone number by an Internet access provider, online service provider, wireless phone service carrier (or as shown on the carrier's billing records) or other organization (e.g., business, educational, institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address or the cellular phone number associated with the wireless phone service provider.
22. Arbitration. Entrants waive all rights to trial in any action or proceeding instituted in connection with these Official Rules and/or this Sweepstakes. Any controversy or claim arising out of or relating to these Official Rules and/or this Sweepstakes shall be settled by binding arbitration in accordance with the commercial arbitration rules of the American Arbitration Association. Any such controversy or claim shall be arbitrated on an individual basis, and shall not be consolidated in any arbitration with any claim or controversy of any other party. The arbitration shall be conducted in the State of New York, in the City of New York, County of New York, and judgment on the arbitration award may be entered into any court having jurisdiction thereof
23. Governing Law and Jurisdiction. This Sweepstakes is governed by United States law and is subject to all applicable federal, state and local laws and regulations. Void where prohibited. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of entrant and Sweepstakes Entities in connection with this Sweepstakes, shall be governed by, and construed in accordance with, the laws of the State of New York, U.S.A., without giving effect to the conflict of laws rules thereof. Any matters or proceedings which are not subject to arbitration as set forth in Section 22 of these Official Rules and/or for entering any judgment on an arbitration award shall take place in the State of New York, in the City of New York, County of New York.
24. Winners List/Official Rules: For a list of Winners send a self-addressed stamped envelope for receipt by August 14, 2006 to: Game Show Marathon Sweepstakes, c/o Marden-Kane, ATTN: MW, 36 Maple Place, Manhasset, NY 11030. For Official Rules mail a U.S. Postal Service postcard to the above address marked "Official Rules Game Show Marathon" for receipt by June 30, 2006. Each Winner's name and home city will be aired on a subsequent Gameshow Marathon broadcast. The list of Winners may also be posted on the CBS.com Service.
