"Best Seat in the House" Contest Official Rules and Participant Release
NO PURCHASE NECESSARY. MUST BE LEGAL RESIDENT OF ONE OF THE 50 UNITED STATES OR D.C, 18 YEARS OF AGE OR OLDER OR AGE OF MAJORITY IN STATE OF RESIDENCE AT DATE OF ENTRY INTO CONTEST. VOID WHERE PROHIBITED BY LAW.
CONTEST DESCRIPTION. "Best Seat in the House Contest" (the "Contest") is a contest for fans to win a trip to the 61st Primetime Emmys Awards (the "61st Emmys Primetime Event") scheduled to be broadcast beginning at 8:00 PM Eastern Time (ET) on September 20, 2009 over the CBS Television Network (the "61st Emmys Program") by uploading a video of themselves telling why they are TV's Number One Fan. Each Participant participating in the Contest will be invited to submit a video submission (the "Participant(s) Video") featuring the Participant answering "Why I am TV's Number One Fan" See Section 4 for details on the Participants' Videos and how to create and submit them. The total number of Participant Videos submitted by all Participants will be narrowed down in accordance with the procedure set forth in paragraph 5, below. The winning Participant Video will be awarded the Grand Prize, as set forth in paragraph 7, below. Sponsor, Administrator, Prize Provider: CBS Interactive Inc., 2200 W. Cypress Creek Road, Fort Lauderdale, FL 33309 Contest Entities: CBS Interactive Inc.; and CBS Broadcasting Inc., 51 West 52nd Street, New York, NY 10019.
1. Acceptance of Official Rules: By entering the Contest operated on the CBS.com Web site accessible at the domain "cbs.com" (the "CBS Service") you ("you", "yourself", "Participant") hereby accept and agree to these official rules (the "Official Rules") of this Contest, and the decisions of the Administrator and the Contest Entities in connection with this Contest, whose decisions are final.
2. Eligibility: This Contest is offered and open to persons who are: (a) "Registered Users", for purposes of these Official Rules, Registered User(s) means a person that has successfully completed the registration form and has obtained a user identification ("ID") and associated password ("Password") on one or more of the following Websites: CBSSports.com, CBSgames.com, cbs.com and/or CBSnews.com; (b) legal residents of one (1) of the fifty (50) United States or District of Columbia; and (c) at least 18 or older or of age of majority in their state of residence at the date of entry in this Contest. Employees, officers, governors, trustees, volunteers and directors, and their immediate family members, of the Contest Entities, and their parents, affiliated and subsidiary companies, advertising and promotion agencies, legal and financial advisors, and talent of any TV show broadcasted through the CBS Television Network are not eligible to participate in this Contest. For purpose of the foregoing "immediate family" means parents, spouses, children, siblings or any members of the same households of such employees and directors. This Contest is void outside of the 50 U.S., in Puerto Rico, all US territories and possessions and where prohibited by law. BY PARTICIPATING IN THIS CONTEST, YOU AGREE THAT THE CONTEST ENTITIES OR THE ADMINISTRATOR MAY, AT THEIR OPTION, CONDUCT A BACKGROUND CHECK CONCERNING YOU, AND THAT, AT ANY TIME AFTER THE BACKGROUND CHECK IS INITIATED, INCLUDING AFTER THE SELECTION OF THE WINNER, THE CONTEST ENTITIES AND THE ADMINISTRATOR RESERVE THE RIGHT TO DISQUALIFY ANY PARTICIPANT ON THE BASIS OF ANYTHING CONTAINED IN, OR OBTAINED AS A RESULT OF, THE BACKGROUND CHECK. SELECTED PARTICIPANTS WILL BE REQUIRED TO SIGN WAIVER FORMS AUTHORIZING THE RELEASE OF PERSONAL AND BACKGROUND INFORMATION AND TO COMPLETE A BACKGROUND QUESTIONNAIRE.
3. Promotional Period: The Promotion begins on August 18, 2009 at 12:00:00 PM PT and ends at 12:00:01 AM PT on September 17 2009 (the "Promotion Period"). Users of the CBS Service will be allowed to upload videos throughout the Promotion Period. Only eligible Participant Videos uploaded starting on August 18, 2009 and ending at 11:59:59 PM PT of September 7, 2009 (the "Entry Period") will be entered into the Contest and be eligible for the Grand Prize. No videos will be accepted for consideration for the Grand Prize after the Entry Period deadline has passed.
4. How to Enter the Contest and Submit the Participant Video: To enter this Contest, during the Entry Period each Participant will have the opportunity to go to http://www.cbs.com/Emmy or www.tv.com/emmy and follow the instructions to complete the Contest entry form, including, without limitation, submitting your ID and Password, and to submit an original Participant Video, of yourself, answering "Why I am TV's Number 1 Fan" ", click the submit button, and you will be entered into this Contest. If you are not a Registered User, you may become a CBS.com Service Registered User and obtain an ID and Password by completing the CBS.com Service registration form on the CBS.com Service. There is no fee or charge to become a Registered User. Participant Video(s) cannot be more than 30 seconds in length and no less than 15 seconds. Participant Video(s) file(s) cannot exceed 250 MB in size. The video must be of your original creation. The performance embodied in the Participant Video entry must be in English and shall not be disparaging, abusive, libelous, defamatory, obscene, vulgar, offensive, indecent, or in any way promote or incite violence, racial hatred, terrorism, or illegal acts, or be otherwise objectionable in the Contest Entities' sole discretion. Additionally, performances which the Contest Entities (or any of them) or the other Contest Entities deem in their sole discretion to be sexually explicit, sexually suggestive, offensive, illegal, pornographic, obscene, in bad taste, or which otherwise may reflect unfavorably on the Contest Entities (or any of them) are not eligible and will be disqualified. Participant Video Requirements:
i. must be a performance depicting yourself answering "Why you are TV's Number 1 Fan";ii. must be no shorter than fifteen (15) seconds in total running time nor longer than thirty (30) seconds in total running time;
iii. must be delivered by uploading the Video to the CBS Service formatted and encoded in accordance with the requirements listed on the CBS Service; the video cannot exceed 250 MB is size.
iv. must not include any person other than the Participant;
v. must not infringe any third party's rights, including, without limitation, copyright, trademark, right of publicity, right of privacy or trade secret and, must not in any way violate applicable laws and regulations or network standards;
vi. must not contain any content or performance that is sexually explicit, sexually suggestive, offensive, illegal, pornographic or obscene or that is in bad taste or is otherwise objectionable to the Contest Entities, or any of them, in their sole discretion;
vii. must not contain libelous or otherwise defamatory statements (including but not limited to words or symbols that are widely considered offensive to individuals of a certain race, ethnicity, religion, sexual orientation or socioeconomic group);
viii. must not include threats to any person, place, business, group or world peace;
ix. must not include thoughts, ideas, lyrics, music, sound recordings, video works, audio-visual works or any creative element other than yourself answering "Why you are TV's Number 1 Fan".
x. must not contain any commercial content that promotes any product or service or contain or reference any third party names, logos, service marks, trademarks, trade names or trade dress or any artwork, including photographs, paintings, statues, etc; and
xi. must satisfy all eligibility requirements set forth herein.
By sending your Participant Video, you grant the Contest Entities a perpetual, worldwide, royalty free license to publish the Participant Video on the CBS Service with no compensation to you other than possibly getting your Participant Video published on the CBS Service. Participant Videos submitted must be suitable for presentation in a public forum, in the sole determination of the Contest Entities. Contest Entities and Administrator reserve the right to reproduce the Participant Videos in full or edit and enhance the Participant Videos at their discretion. Contest Entities and Administrator are authorized to use the Participant Videos as they see fit in all media, including without limitation usage in promotion and advertising. All Participant Videos are licensed to Sponsor in a perpetual and royalty free manner and will not be returned to participants. Administrator will not be responsible for lost, stolen or misplaced entries.
Limit of one (1) Participant Video per person.
As part of the registration process for participation in the Contest, Participant will be required to click where indicated to signify that you have read, accepted and agree to be bound by these Official Contest Rules and Release and the terms hereunder, including but not limited to the releases of liability and the licenses granted herein (see Rule 11 & 12), including the decisions of the judges and, when applicable, the Administrator and/or the Contest Entities, or any of them, which are final and binding in all respects. If broadcast of the 61st Emmys Primetime Program is preempted, re-scheduled or cancelled for any reason, the Contest Entities reserve the right to terminate the Contest, or change any of the applicable dates herein, including, without limitation, the dates for the Promotion and/or Entry Period. Notice of any such changes or termination will be posted online on the CBS Service.
5. Judging: The winning Participant Video will be selected by a combination of voting from users of the CBS Service and a panel of judges (the "Judging Panel") comprised of representatives of the Contest Entities, whose decisions will be final and binding in all respects. The Judging Panel will judge all of the Participant Videos uploaded based on the following criteria: creativity (25%), originality (25%), body language (25%), and performing ability (25%). The top videos may/will then be published on TV.com and the CBS Service. Users will vote for their favorite Participant Video in three (3) different stages (each a "Voting Window"), based on the schedule below. Users of the CBS Service in combination with the Judging Panel will vote during the first Voting Window to narrow down the number of Participant Videos published by the Judging Panel to Fifteen (15) semi-finalists based on the Participant Videos that receive the most numbers of votes; users of the CBS Service will vote during the second Voting Window to narrow down the number of Participant Videos from the fifteen (15) semi-finalists to five (5) finalists; users of the CBS Service will vote during the third Voting Window to narrow the number of Participant Videos down from five (5) finalists to the one (1) winner. The CBS Service users' votes will count as 33% of the deciding factors when combined with the Judging Panel's votes that account for 67% of the deciding factors. In the event an exact duplicate Participant Video is submitted, only the first such Participant Video received will be considered. All videos must be submitted by the end of the Entry Period (11:59:59 PM PT on September 7, 2009) in order to be eligible for the Grand Prize. Participants will be notified by email if such Participant's Video was accepted or rejected. Any video submitted after this deadline will not be considered for the Grand Prize and will not be eligible to be voted on.
6. Schedule of Voting Windows:
All Voting Windows begin at 12:00:01 PM PT and end at 11:59:59 AM PT (with the exception of the last Voting Window, which closes at 12:00:01 AM PT) on the scheduled dates below:
- First Voting Window to decide the Top 15 Participant Videos starts 9/8/09 and ends on 9/11/09.
- Second Voting Window to decide the Top 5 Participant Videos starts 9/12/09 and ends on 9/14/09.
- Third Voting Window to decide the Grand Prize Winner starts 9/15/09 and ends on 9/17/09.
After the conclusion of each Voting Window, the Participant Videos with the most votes will move into the next Voting Window. After the conclusion of each Voting Window, each Participant Video's score goes back to zero. After the conclusion of the last Voting Window, the eligible Participant who submitted the Participant Video with the most votes from both the Panel of Judges and the CBS Service users and is depicted on the Participant Video will be the Grand Prize Winner (the "Grand Prize Winner"). The Sponsors and the Contest Entities reserve the right to eliminate and/or alter any Voting Window period in the case that not enough eligible Participant Videos are received in time.
7. Grand Prize: One (1) Grand Prize that consists of a trip for Grand Prize winner to Los Angeles, CA to attend the 61st Emmys Program (subject to availability). Grand Prize includes round-trip coach air transportation for Grand Prize winner to Los Angeles, CA from a single major U.S. airport nearest Grand Prize winner's home (as determined by Sponsor), single occupancy standard hotel accommodations for three (3) nights, ground transfers to and from airport in Los Angeles and from hotel to location of the 61st Emmys Program. Trip destination and dates are at the sole discretion of Sponsor. Approximate retail price of the Grand Prize is Two Thousand Five Hundred Dollars (US$2,500.00)
8. Prize Restrictions: If the 61st Primetime Emmys Program is canceled, rescheduled (or, if for any reason, Sponsor is unable to provide the 61st Emmys Program portion of the Grand Prize or if Grand Prize winner cannot take the trip on a dates specified by the Sponsor, the Sponsor shall have no further obligation to a prize winner and guest other than to supply the trip as described within one (1) year from date of prize notification, minus the 61st Emmys Program experience and ground transfers. All other expenses relating to acceptance of the Grand Prize not explicitly stated herein, including but not limited to taxes, meals, beverages, alcoholic beverages and gratuities are responsibility of the Grand Prize winner and guest. Certain travel restrictions may apply. Specifics of Grand Prize travel package are subject to availability and Sponsor's sole discretion. Complete terms and conditions of Grand Prize trip will be furnished with prize notification. Travel must be made through Sponsor's agent on a carrier of Sponsor's choice. Reservations are subject to availability. Travel restrictions and blackout dates may apply. Grand Prize winner and guest must travel on the same itinerary and are responsible for obtaining all required travel documents. If Grand Prize winner resides within a 100 mile radius of the 61st Emmys Event, ground transportation may be provided for Grand Prize winner and guest in lieu of air transportation and no compensation or substitution will be provided for difference in prize value. Travel companion of Grand Prize winner must be 18 years of age or older as of date of travel and will be required to execute and return a liability/publicity release (unless prohibited by law) prior to ticketing. Administrator, and/or any other relevant party, reserves the right to remove or to deny entry to Grand Prize Winner and/or guest who engages in a non-sportsmanlike or disruptive manner, or acts with the intent to annoy, abuse, threaten or harass any other person. Actual value may vary based on place of departure and dates of travel.
No assignment, transfer, conversion to cash or cash redemption or substitution of the Grand Prize is permitted, except Administrator reserves the right to substitute Grand Prize or any of its components with a prize of comparable or greater value should the Grand Prize or any of its components become unavailable. Grand Prize is solely for personal use and may not be used in conjunction with any other promotion.
9. Odds/Drawing/Winner Notification: Odds of winning the Grand Prize depends on the number of eligible video entries received during the Entry Period and votes received during the Voting Window of the Contest's Promotion Period. Grand Prize Winner will be determined on or about September 17, 2009 and may be announced on or about September 20, 2009 during the 61st Emmys Program. Potential Grand Prize Winner will be notified by phone. If the potential Grand Prize Winner cannot be reached after a reasonable effort has been made during twenty-four (24) hours from the first notification attempt, such person may be disqualified. The alternate Grand Prize Winner shall be the Participant Video that had the next highest number of votes in the final Voting Window.
10. Prize Taxes: All federal, state, local and other tax obligations arising from this Contest, including, without limitation, winning the Grand Prize, will be the sole responsibility of the Grand Prize Winner.
11. Affidavit of Eligibility/Liability Release and Publicity Release: Grand Prize Winner will be required to complete, execute and return an Affidavit of Eligibility/Liability Release, and where lawful, a Publicity Release (collectively, the "Release Forms") within 24 hours of notification of winning. Failure to return Release Forms timely, or if Grand Prize notification or the Grand Prize is returned as non-deliverable, or if Grand Prize Winner is found not to be eligible or not in compliance with these Official Rules, may result in disqualification with an alternate Grand Prize Winner selected in accordance with these Official Rules.
11A. Conditions of Entry: As conditions of entry into the Contest, each Participant: (a) irrevocably licenses to Sponsor and their affiliates, legal representatives, assigns, agents and licensees, on a perpetual, worldwide, royalty-free, non-exclusive, sublicensable, unconditional and transferable basis, the right to reproduce, encode, store, modify, copy, transmit, publish, post, broadcast, display, publicly perform, adapt, exhibit and/or otherwise use or reuse (without limitation as to when or to the number of times used), the Participant's name, address, image, voice, likeness, statements, biographical material and any materials included as part of Participant's entry into the Contest, including, but not limited to, the Participant Video or digital recording and performances contained in any of the above items, and all recordings or videos made or submitted in connection with the Contest ("Entry Materials"), as well as any additional photographic images, video images, portraits, interviews or other materials relating to the Participant and arising out of his/her participation in this Contest (with or without using the Participant's name) (collectively, the "Additional Materials") (in each case, as submitted or as edited/modified in any way, whether by the Sponsors, their licensees, or assigns, in the Sponsors' sole discretion) in any media, format or medium throughout the world for any purpose, without limitation, including the 61st Emmys Program, and without additional review, compensation to, or approval from the Participant or any other party, except as prohibited by law; Nothing herein shall be construed as obligating Sponsor in any way to include any Participant's Video including the Winner's Participant Video, or the Winner in the 61st Emmys Program. (b) understands that Participant's appearance, actions, depiction and/or portrayal in Participant's Video, Participant's Entry Materials or Additional Materials and in any promotion thereof, may be disparaging, defamatory, embarrassing or of an otherwise unfavorable nature and may expose Participant to public ridicule, humiliation or condemnation. Participant acknowledges and agree that the Sponsors shall have the right to include any such information and any such appearance, depiction, portrayal, actions and statements in Participants Video, Participant's Entry Materials and/or Additional Materials as edited by Sponsors and/or other Contest Entities in their sole discretion. Participant forever waives any rights of privacy, rights of publicity, intellectual property rights, claims of defamation, and any other legal or moral rights that may preclude Sponsors' and/or other Contest Entities' use of Participants Video, the Participant's Entry Materials or Additional Materials, or require the Participant's permission for Sponsors or other Contest Entities to use them for any purpose, and releases and agrees never to sue or assert any claim against the Sponsors or other Contest Entities arising out of use of those Entry Materials or Additional Materials or otherwise; (c) acknowledges and agrees that (i) Sponsors have access to and/or may create or have created literary, film, tape and/or other materials, ideas and concepts which may be similar or identical to the Entry Materials in theme, idea, plot, format, characters and/or other respects; (ii) Participant will not be entitled to any compensation or other consideration because of the use by Sponsors of any such similar or identical material, ideas and/or concepts; and (iii) Sponsors' use of material containing elements similar to or identical with those contained in the Participant Video, Participant's Entry Materials or any Video shall not obligate Sponsors to negotiate with nor entitle Participant to any compensation or other claim;
12. Publicity Release Terms: Except where prohibited by law, the Grand Prize Winner's acceptance of the Grand Prize constitutes permission for the Contest Entities to use Grand Prize Winner's name, photograph, likeness, statements, biographical information, voice, and address (city and state) worldwide and in all forms of media, in perpetuity, without further compensation.
13. Improper Conduct: Administrator or the Contest Entities, or any of them, in their sole discretion, may disqualify any Participant from participation in or use of any or all portions of this Contest, and refuse to award the Grand Prize, if Participant engages in any conduct Administrator deems to be improper, unfair or otherwise adverse to the operation of the Contest or detrimental to other Participants of the Contest or to any person or third-party. Such improper conduct includes, without limitation, falsifying personal information required during Participant registration or Grand Prize claim, violating any term or condition stated herein, including but not limited to the outline in Rule 4 of these Official Rules, accumulating entries through methods such as automated computer scripts or any other programming techniques, allowing others to use Participant's personal information for the purpose of accumulating entries, or intentionally trying to defraud, reverse engineer, disassemble or otherwise tamper with the computer programs in connection with this Contest. Participants agree that Administrator may void any part of the Grand Prize that Participant may have won and/or require the return of any part of the Grand Prize that Participant may have won as a result of such improper conduct. Participant further acknowledges that any forfeiture of the Grand Prize and/or return of the Grand Prize shall in no way prevent Administrator from pursuing other avenues of recourse such as criminal or civil proceedings in connection with such conduct. WARNING: ANY ATTEMPT TO DELIBERATELY DAMAGE OR UNDERMINE THE LEGITIMATE OPERATION OF THIS CONTEST MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, EACH OF THE CONTEST ENTITIES RESERVES THE RIGHT TO SEEK DAMAGES OR OTHER REMEDIES FROM ANY SUCH PERSON(S) RESPONSIBLE FOR SUCH ATTEMPT TO THE FULLEST EXTENT PERMITTED BY LAW.
14. Integrity of Contest: If, for any reason, the Contest is not capable of running as planned by reason of infection by computer virus, worms, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes which Administrator, in its sole opinion believes could corrupt or affect the administration, security, fairness, integrity or proper conduct of this Contest, Administrator and/or the Contest Entities, or any of them, reserve the right at its sole discretion to cancel, terminate, modify or suspend this Contest and select the Grand Prize Winner from entries received prior to the action taken or in such other manner as Administrator may deem fair and appropriate.
15. Lost or Corrupted Entries: The Contest Entities, and their parents, affiliated and subsidiary companies and advertising and promotion agencies, as well as all of the foregoing's affiliates, officers, directors, agents, co-branders, or other partners, employees, governors, trustees, and volunteers, and their respective successors and assigns, assume no liability and are not responsible for, and you hereby forever waive any rights to any claim in connection with, lost, late, incomplete, corrupted, stolen, misdirected, illegible or postage due entries or mail, if applicable; or for any computer, telephone, cable, network, satellite, electronic or Internet hardware or software malfunctions, unauthorized human intervention, or the incorrect or inaccurate capture of entry or other information, or the failure to capture any such information. The Contest Entities, and their parents, affiliated and subsidiary companies, advertising and promotion agencies, are not responsible for any incorrect or inaccurate information, whether caused by registration information submitted by end users or tampering, hacking, or by any of the equipment or programming associated with or utilized in this Contest, and assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to the Contest.
16. Damaged Property: Contest Entities, and their parents, affiliated and subsidiary companies and advertising and promotion agencies, as well as all of the foregoing's affiliates, officers, directors, agents, co-branders, or other partners, employees, governors, trustees, and volunteers, and their respective successors and assigns, assume no liability and are not responsible for, and you hereby forever waive any rights to any claim in connection with, injury or damage to any Participants or to any other person's computer or property related to or resulting from participating in this Contest or downloading materials from this Contest.
17. Contest Errors: The Contest Entities, and their parents, affiliated and subsidiary companies and advertising and promotion agencies, as well as all of the foregoing's affiliates, officers, directors, agents, co-branders, or other partners, employees, governors, trustees, and volunteers, and their respective successors and assigns, assume no liability and are not responsible for, and you hereby forever waive any rights to any claim in connection with, errors and/or ambiguity: (a) in the Contest; (b) in any related advertising or promotions of this Contest; and/or (c) in these Official Rules. In the event of any ambiguity(s) or error(s) in these Official Rules, Administrator and the Contest Entities, or any of them, reserve the right to modify these Official Rules for clarification purposes or to correct any such ambiguity or error(s) without materially affecting the terms and conditions of the Contest.
18. Grand Prize and Grand Prize Winner: The Contest Entities, and their parents, affiliated and subsidiary companies and advertising and promotion agencies, as well as all of the foregoing's affiliates, officers, directors, agents, co-branders, or other partners, employees, governors, trustees, and volunteers, and their respective successors and assigns, assume no liability and are not responsible for, and you/Participant hereby forever waive/s any rights to any claim in connection with, the selection and announcement of the Grand Prize Winner, the distribution of the Grand Prize, the acceptance/possession and/or use/misuse of any part of the Grand Prize and/or any injury or damage to any Participant's or third person's property related to or resulting from any part of the Grand Prize or any part of this Contest.
19. Release and Indemnity: Each Participant in this Contest, including, without limitation, the Grand Prize Winner, hereby releases and agrees to hold harmless the Contest Entities and the Academy of Television Arts & Sciences and their parents, affiliates, subsidiaries, advertising and promotion agencies and their respective directors, officers, employees, representatives and agents from any and all liability for any injuries, loss or damage of any kind to person, including death, and property, arising in whole or in part, directly or indirectly, from acceptance, possession, use or misuse of the Grand Prize, participation in this Contest and participation in any activity related to this Contest.
20. Limitation of Liability: IN NO EVENT WILL THE CONTEST ENTITIES ,THEIR PARENTS, AFFILIATES, SUBSIDIARIES AND RELATED COMPANIES, THEIR ADVERTISING OR PROMOTION AGENCIES OR THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, REPRESENTATIVES AND AGENTS, BE RESPONSIBLE OR LIABLE FOR ANY DAMAGES OR LOSSES OF ANY KIND, INCLUDING DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES ARISING OUT OF YOUR ACCESS TO AND USE OF THE CONTEST OR THE DOWNLOADING FROM AND/OR PRINTING MATERIAL DOWNLOADED FROM THE CONTEST. 22. Identity Disputes: In the event of a dispute as to the identity of a winner based on an email address, the winning entry will be declared made by the Authorized Account Holder of the email address submitted at time of entry. For purposes of these Official Rules, "Authorized Account Holder" is defined as the natural person who is assigned to an email address by an Internet access provider, online service provider or other organization (e.g., business, educational, institution, etc.) that is responsible for assigning email addresses for the domain associated with the submitted email address.
23. Binding Arbitration: The parties waive all rights to trial in any action or proceeding instituted in connection with these Official Rules and/or this Contest. Any controversy or claim arising out of or relating to these Official Rules and/or this Contest shall be settled by binding arbitration in accordance with the commercial arbitration rules of the American Arbitration Association. Any such controversy or claim shall be arbitrated on an individual basis, and shall not be consolidated in any arbitration with any claim or controversy of any other party. The arbitration shall be conducted in the State of California, in the City of San Francisco, and judgment on the arbitration award may be entered into any court having jurisdiction thereof.
24. Governing Law and Jurisdiction: This promotion is governed by US law and is subject to all applicable federal, state and local laws and regulations. Void where prohibited by law. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of Participant and Administrator in connection with this Contest, shall be governed by, and construed in accordance with, the laws of the State of California, U.S.A., without giving effect to the conflict of laws rules thereof, and any matters or proceedings which are not subject to arbitration as set forth in Section 23 of these Official Rules and/or for entering any judgment on an arbitration award, shall take place in the State of California, in the City of San Francisco.

Winner List/Official Rules: For the name of the Grand Prize Winner send a self addressed stamped envelope for receipt by September 30, 2009 to "Winner list Best Seat in the House Contest" c/o CBS Interactive Inc., 2200 W. Cypress Creek Rd., Fort Lauderdale, FL 33309. For a copy of the Official Rules send a self addressed stamped envelope to the above address marked "Official Rules: "Best Seat in the House Contest" for receipt by September 17, 2009; residents from VT may omit postage on the self addressed envelope. The full name of the Grand Prize Winner may be posted on TV.com and/or CBS.com website. The Official Rules will be posted on the CBS Service.
