LOVE ISLAND FAN VOTING PROGRAM
VOTING OPEN TO RESIDENTS OF THE UNITED STATES AND CANADA; 18 YEARS OR OLDER, OR WITH PERMISSION FROM PARENTS OR GUARDIAN. DATA CHARGES MAY APPLY TO PARTICIPATE IN THE PROGRAM.
THIS PROGRAM IS NOT SPONSORED, ENDORSED OR ADMINISTERED BY ANY SOCIAL MEDIA PLATFORM.
Sponsor: CBS Broadcasting Inc. ("CBS"), the Producers of the Show, 235 Second Street, San Francisco, California 94105.
1. Acceptance of Terms and Conditions: By voting on the Love Island Fan Voting Program (the "Program"), connected to the CBS TV Show "Love Island" (the "Show"), you hereby accept and agree to the terms of the Program, accessible at https://www.cbs.com/recommended/news/1009321/love-island-usa-voting-terms-and-conditions (the "Terms"). The Program is also subject to the Show instructions accessible on the Show's mobile application (the "App") incorporated herein by reference, the CBS Interactive Inc. Terms of Use found at https://www.viacomcbs.legal/us/en/cbsi/terms-of-use and Privacy Policy found at https://www.viacomcbsprivacy.com/policy. The Terms, the Instruction Page, the Privacy Policy and the Terms of Use collectively, the "Policies."
If you participate in the Program via wireless device (i.e. smart phone, tablet or other wireless device that allows you access to the internet) during the Voting Period; you may be charged data rates according to the Terms and Conditions of your Service Agreement with your wireless carrier.
2. Voting Periods: The Program will be available starting on July 7, 2021, and ending August 15, 2021 (the "Program Period"). The Program Period will include various separate voting periods (each, a "Voting Period") as specified by Sponsor via the Show, the App, and/or social media. Each Voting Period will usually last approximately thirty (30) minutes starting at the end of the broadcast of the Show (timing applies to each of the East Coast and West Coast transmission); however, some Voting Periods may last longer than that, at Sponsor's sole and exclusive discretion. Once voting closes on the West Coast all votes will be added and results tabulated. Notwithstanding the aforementioned, Sponsor may at any time and in its sole discretion add or eliminate Voting Periods already announced or shift any Voting Period and post notice of such change or shift on the Show's App (the "App"), during the Show and/or via social media. The Show's broadcasts are subject to preemption and schedule changes. Please check local television listings for the Show's broadcast dates/times in your country/area. Please Note: The Show will be simultaneously broadcasted in Canada. Voting results for all Voting Periods shall include all eligible votes received from both the U.S. and Canada, via Show App.
3. Vote Description: During a Voting Period, viewers of the Show will be asked to interact with the Show by voting on a variety of topics (the "topic(s)") including, without limitation, which Islander(s) they wish to keep in the Show, which Islander(s) to eliminate, and which Islander(s) will go on a date or get a reward. In the case of votes to keep Islander(s) in the Show, the Islander(s) with the lowest number of votes may be eliminated from the Show. In the case of votes to eliminate Islander(s) from the Show and/or going on a date or getting rewards, the Islander(s) with the highest number of votes may be eliminated from the Show or get a date or a reward, as applicable. In each case, the voting format (be it for elimination or another topic), and any specific terms relating to that particular vote, will be announced in the applicable on-air interaction information during the Show, on authorized social media and/or within the App, before the applicable Voting Period opens. Viewers will vote via the App on the applicable platform/devices as stated below. Sponsor reserves the right to vary the format of any Voting Period, at its sole discretion. Sponsor may allow Islanders to vote on various topics, even on topics viewers may have already voted on; and may add restrictions to such Islanders' votes at its sole discretion. "Islanders" means for the purpose of these Terms, the participants appearing and competing on the Show.
4. How to Participate:
Voting: Participants may vote, during a Voting Period, via the App. Users of Apple mobile devices with iOS for iPhones, iPad and iPad minis and users of mobile devices with Android may download the latest version of the official Show App from the relevant app store (iTunes store or the Google Play store). Download of the App is free. All users will be required to register before being able to vote and should follow the in-app prompts to do so. Users may only register, for voting, two (2) of the allowed devices with the same number/account. App users should follow the in-app instructions to vote during each Voting Period. There is no charge when voting via the App, however, please be aware that you may accrue data rates according to your Service Agreement with your wireless carrier.
For Apple users, the App runs on iOS 11.4.1 and upwards. For Android users, the App runs on Android 5 and upwards. Please upgrade your operating system if your compatible mobile device is running on iOSv10 or below or Android 4.4 or below.
If there are technical or other issues with the App votes, the Sponsor reserves the right to discount the App votes (as applicable) and announce the result of the vote without including those affected votes.
There is a maximum of one (1) vote per user, per topic, per allowed device(s) (up to two devices), per Voting Period. A Voting Period may include more than one topic for users to vote on. In the event Sponsor discovers users are voting in excess of the allowed limit, the Sponsor reserves the right to discount all or just those extra App votes (as applicable) and announce the result of the vote without including those affected votes and/or decide the outcome of the vote.
Once a Voting Period concludes and results are tabulated, the results shall be revealed during the applicable broadcast of the Show, via the App and/or Social Media.
IN NO EVENT WILL SPONSOR, ITS PARENT, SUBSIDIARY, LICENSEES, LWT ENTERPRISES INC. AND/OR AFFILIATES AND RELATED COMPANIES, THEIR SPONSORS, ADVERTISING OR PROMOTION AGENCIES OR THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, REPRESENTATIVES, AND AGENTS (COLLECTIVELY, THE "ADMINISTRATORS"), BE RESPONSIBLE OR LIABLE FOR ANY DAMAGES OR LOSSES OF ANY KIND, INCLUDING DIRECT, INDIRECT INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES ARISING OUT OF LOST, INCOMPLETE, LATE, DAMAGED, OR ONLINE COMMUNICATIONS; FAILURES OR MALFUNCTIONS OF PHONES (INCLUDING WIRELESS PHONES/HANDSETS); PHONE LINES OR TELEPHONE SYSTEMS OR OTHER COMMUNICATIONS MALFUNCTIONS; CELLULAR EQUIPMENT TOWERS, TELEPHONE SYSTEMS OR WIRELESS SERVICES; INTERRUPTED OR UNAVAILABLE NETWORK OR SERVERS; MISCOMMUNICATIONS, FAILED COMPUTER HARDWARE OR SOFTWARE OR OTHER TECHNICAL FAILURES; GARBLED, LOST, MISROUTED OR SCRAMBLED TRANSMISSIONS; ANY ERROR, OMISSION, INTERRUPTION, DEFECT OR DELAY IN ANY TRANSMISSION OR COMMUNICATION; TRAFFIC CONGESTION OR FOR ANY OTHER TECHNICAL PROBLEM; ERRORS IN RECEIPT OR TABULATION OF VOTES VIA ONLINE VOTING.
Administrators are not responsible for any injuries, loss, or damage of any kind to person, including death, and property arising in whole or in part, directly or indirectly, from participation in the Program. Sponsor is not responsible for any technical failures or malfunctions of the voting platform.
5. Show/Competition: The Show is a competition between the Islanders. The Islanders are competing as couples for a chance at a cash prize. During the final episode of the Show the couple that receives the most valid votes may be declared the winners of the competition. The Sponsor may at its sole discretion eliminate an Islander for any reason and/or reintroduce an Islander seen in earlier stages of the competition who was previously dumped. All Sponsor's decisions in connection with the Show will be final.
If any of the Islander(s) leave or are removed from the Show for any reason, including without limitation medical reasons, then the Sponsor will in its sole discretion decide whether such Islander(s) will be removed from the vote or the vote may be cancelled and restarted without such Islander(s), having regard to all circumstances and information available to them at the relevant time. The Sponsor will in its sole discretion determine if another Islander may be allowed to enter the competition.
If the outcome of a vote cannot be reasonably determined because of a technical failure, a tie, or for any other circumstance beyond the reasonable control of the Sponsor, then the Sponsor may choose (at its sole discretion) to cancel the vote and reopen it at a later date; or the Sponsor will determine the outcome; or may allow the other Islanders to determine the outcome.
If a Voting Period is cancelled, then at the Sponsor's discretion either the Islander(s) will decide on the outcome of that vote, or the vote will be postponed. Any decision by the Islanders, or by Sponsor will be final.
Without limiting anything in these Terms, if there are technical or other issues with the App vote, or other circumstance, then at the Sponsor's sole discretion the voting mechanic may be changed.
Sponsor reserves the right in its sole discretion to disqualify any votes made above the permitted levels having regard to all the circumstances and information available at the relevant time.
6. Additional Disclaimers: If for any reason the Program is not capable of being executed as planned, or if there is an infection by computer virus, bugs, tampering, unauthorized intervention, fraud or technical failures, or if any other causes beyond the control of Administrators corrupt or affect the administration, security, fairness, integrity, or proper conduct of this Program, the Administrators reserve the right, in their sole discretion, to withdraw the transmission of, or to disqualify, any vote. Furthermore, the Administrators may temporarily or permanently disqualify from any promotion any person they believe has violated these terms, terminate or suspend voting at any point, and/or declare the vote results based on the votes up to that point, if it appears that the voting process has been so distorted by hacking or other interference that the results would not reflect actual valid votes should the voting continue. In the event of technical difficulties with the voting, Administrators reserve the right to review the votes for accuracy and to take any appropriate action, including, without limitation, voiding the votes cast during the Voting Period in which such technical difficulties occurred. Administrators and their respective agents, officers, directors, employees, subsidiaries and affiliates assume no responsibility for any injury or damage to participants or to any other person's computer relating to or resulting from entering or downloading materials or software in connection with this Program. Administrators are not responsible for telecommunications, network, electronic, technical or computer failures of any kind, for inaccurate transcription of voting information, errors in any promotional or marketing materials, for any human or electronic error, or for votes that are stolen, misdirected, garbled, delayed by computer transmissions, lost, or late.
These Terms and Conditions are subject to change at any time at the sole discretion of the Sponsor. Notification regarding any such change will be posted on the Show's website and/or the App.
Administrators reserve the right, for any reason and in their sole discretion, to modify, suspend or discontinue the Program without prior notice.
Caution: Any attempt by an individual to deliberately damage any online service or website, tamper with the voting process, or otherwise undermine the legitimate operation of the Program is a violation of criminal and civil laws and should such an attempt be made, Administrators reserve the right to seek damages and/or other remedies from any such person to the fullest extent permitted by law.
7. Conditions for Voting: Administrators reserve the right to disqualify, block or remove any votes from any individual who votes by any electronic, mechanical or automated means, or otherwise tampers with the Program, or for any other reason, as determined by Administrators in their sole discretion.
Administrators are not responsible for any damages to voters' device(s) that may occur from use of service. Administrators reserve the right, for any reason and in their sole discretion, to modify, suspend or discontinue the Program without prior notice.
