OFFICIAL RULES
RE-PLAY: SURVIVOR VIDEO CONTEST
NO PURCHASE NECESSARY TO ENTER OR WIN. CONTEST OPEN TO UNITED STATES CITIZENS WHO ARE 18 OR OLDER. CONTEST VOID WHERE PROHIBITED.
1) CONTEST DESCRIPTION: The Re-Play: Survivor Video Contest (the "Contest") is a skill contest that begins on or about 2/10/05 and ends on 5/16/05 ("Promotion Period"). Contest entrants may submit an original video recording recreating one of the entrant's favorite moments from any of the previously broadcast Survivor series seasons (excluding Survivor: Palau) ("Video Entry"). A Video Entry may not exceed 3 minutes in length. Limit one Video Entry per person. Video Entries and completed forms must be submitted between 2/10/05 and 3/31/05. Weekly beginning 3/4/05 and ending 5/13/05 ("Weekly Voting Period") four (4) entries ("Weekly Finalists") as determined by the Sponsor's entry review panel will be posted on Survivor Live: The Internet Talk Show, a webcast available at CBS.com on Fridays beginning at 3 PM ET/PT. The general public will be invited to view and vote on the Weekly Finalists and Grand Prize Finalists via CBS.com. A Visitor to CBS.com may judge the four (4) Weekly Finalists' VideoEntries for each week and the ten (10) Grand Prize Finalists Video Entries and cast one vote for his or her highest scoring Video Entry. The single Weekly Finalist Video Entry receiving the most votes for that specific weekly vote will be deemed the winner of that week's competition and will be awarded a weekly prize. Ten (10) weekly winners advance to the grand prize vote. A calendar showing the voting schedule can be found at the end of these rules. Limit one vote per week per voter.
2) HOW TO ENTER: Complete contest information is available at www.CBS.com/survivor. Persons wishing to participate as a contest entrant are required to do the following: a) register online between 2/10/05 and 3/31/05; b) acknowledge reading and accepting these Official Rules; c) print out the following forms: (i) entry form; (ii) Release and Indemnification; and (iii) Third Party Consent and Release; d) create a Video Entry; e) submit Video Entry and all required forms, properly executed by the entry cut-off date 3/31/05. Entrants will be asked to submit a Video Entry that recreates any one of their favorite Survivor series moments. Entrants must comply with the following directions when creating their Video Entry. A Video Entry may be submitted on VHS or DVD; no other format will be accepted. Submissions may not be longer than 3 minutes total. No more than a total of eight (8) persons may appear in any Video Entry. All entrants and persons appearing in the Video Entry must be United States citizens residing in one of the fifty United States and the District of Columbia and must sign consent and release forms before the submission can be eligible for judging. Parent or guardian must sign the consent/release form for minors (any person under the age of 18 or under the age of majority in such person's state of residency). All Video Entries must be the original creation of each entrant and not contain any material provided by any third parties. All persons other than entrant appearing in the Video Entry must sign the Third Party Consent and Release. No music of any kind may be inserted into the Video Entry other than the music, if any, that may be specifically provided for on CBS.com and which has been designated by CBS.com for insertion into the Video Entry. For purposes of clarity, CBS.com shall not be obligated to provide any music for use in the Video Entry, and in the event that CBS.com does not provide such music, no music may be included in the Video Entry. All Video Entries must comply with all laws, rules and regulations including, but not limited to, those concerning copyright, trademark, defamation and invasion of privacy. Accordingly, no branded or copyrighted material, including any photographs, may be included in the Video Entry. An example of branded material would be clothing, equipment, props or other merchandise containing brand names, logos, or any other identifier. In addition, Video Entries may not contain recitals of poetry or lyrics from songs or lines from movies or any other television program other than Survivor. Nor may any Video Entry contain, including in the background, any signs, building marquis or any other similar markings. Further a Video Entry may not contain any material that is defamatory of, or violates the privacy rights, of any individual or entity. A Video Entry which contains any prohibited material or more than eight (8) persons will be disqualified. Failure to provide requested releases will also result in disqualification of entrant. Video Entry must be clearly and legibly labeled with title of entry, entrant's name, complete mailing address, daytime phone number and e-mail address and the name of each participant included in the Video Entry. To submit a Video Entry, complete and properly execute the required forms available for print-out. Mail completed forms along with your Video Entry to: CBS Survivor Video Contest, c/o CBS.com, CBS Television City, 7800 Beverly Blvd., Los Angeles, California 90036. Video Entries and completed forms must be postmarked by 3/31/05 and received by 4/7/05. Video Entries and completed forms may only be submitted via U. S. Mail or any other conventional mail delivery service (including overnight mail courier service, such as Airborne, DHL, Federal Express, UPS, etc.); online, messenger or personally delivered entries will not be accepted. All Video Entries and accompanying forms become the property of the Sponsor and will not be acknowledged or returned. Limit: One (1) Video Entry per person. Subsequent Video Entries submitted by a single entrant are void, as are incomplete, illegible, misdirected or postage due Video Entries and accompanying forms. Each person who enters the Contest fully and unconditionally agrees to comply with and abide by these Official Rules and the decisions of the Sponsor, and judges (CBS.com and public vote) which shall be final and binding in all respects.
3) JUDGING: Video Entries and accompanying forms will first be screened for proper documentation. If accompanying documents are incomplete or missing, the Video Entry will not be deemed eligible for judging. Eligible Video Entries will first be judged by the Sponsor's entry review panel ("Panel") under the supervision of CBS.com. This Panel of judges will score eligible Video Entries using the following criteria: Entertainment Value: 50 point max.; Presentation: 25 points max.; Creativity: 25 points max. Video Entries will be judged on an ongoing basis. Video Entries received but not judged before the cut-off for a Weekly Voting Period will roll over into the next Weekly Voting Period until such time that all eligible received Video Entries are judged, but no later that 4/28/05. Four (4) Weekly Finalists with the highest scores will be determined by the Panel, such determination shall be final and binding. In the event of a tie, those Video Entries will be reviewed by an additional Panel member who will serve as a tiebreaker and who will evaluate tied Video Entries using the judging criteria noted above. Panel may opt to feature fewer than four (4) entries in a Weekly Voting Period. Weekly Finalists Video Entries are subject to validation and verification of eligibility and compliance with all terms and conditions set forth in these Official Rules. All Video Entries must conform to CBS Broadcasting Inc. Broadcast Standards and Practices policies. Sponsor and Releasees assume no responsibility for any Video Entry in which the reenactment places the entrant, or any other person at risk for personal injury or property loss. If in the judges opinion a Video Entry contains content that appears to have put any person in danger of physical injury or property loss, such Video Entry will be deemed void.
4) VOTING PERIODS: There are ten (10) Weekly Voting Periods and one (1) Grand Prize Voting Period (see calendar at end of rules.) During each Weekly Voting Period a maximum of four (4) Weekly Finalist Video Entries will be posted on Survivor Live: The Internet Talk Show, a Web cast available at CBS.com on Fridays 3 PM ET/PT. The public will be urged to vote for one Weekly Finalist Video with the highest score based upon the following criteria: Entertainment Value: 50 points maximum; Presentation: 25 points maximum; Creativity: 25 points maximum. Upon conclusion of each Weekly Voting Period, the Sponsor will tally the votes received and determine the weekly prize winner based on the Video Entry receiving the greatest number of valid votes that week. Grand Prize Voting Period: The ten (10) Weekly Winners will compete in the Grand Prize Vote. Judging for grand prize voting will be conducted in the same manner as noted above for the Weekly Voting Period. However, Sponsor may elect to conduct Semi-finalist vote(s) in which case notice of Semi-Finalist vote(s) dates will be posted in these Official Rules. Winning any prize is subject to validation and verification of eligibility and compliance with all terms and conditions set forth in the Official Rules. In the event of a tied score, the Video Entry which received the highest score from the CBS.com Panel will be deemed the Winner for the respective voting period. Disclosing vote tabulations is optional at Sponsor's discretion.
5) REPRESENTATIONS AND WARRANTIES/INDEMNIFICATION: Each person who enters this Contest represents and warrants to Sponsor as follows: (i) the Video Entry is the entrant's own original, previously unpublished, unbroadcast and previously unproduced work; (ii) the Video Entry is wholly original with entrant and as of the date of submission, is not the subject of any actual or threatened litigation or claim; (iii) the Video Entry neither infringes upon nor violates the intellectual property rights or other rights of any other person or entity; (iv) the Video Entry does not and will not violate any applicable laws, and is not and will not be defamatory, libelous, pornographic, or obscene; and (v) neither the entrant nor any person appearing in the Video Entry shall be member(s) of the Screen Actors Guild and/or the American Federation of Television and Radio Artists ("SAG/AFTRA"); (vi) the Video Entry otherwise complies withal the requirements set forth in the Official Rules. Each entrant hereby agrees to indemnify and hold the "Releasees" (defined below) harmless from and against any and all third party claims, actions or proceedings of any kind and from any and all damages, liabilities, costs and expenses relating to or arising out of any breach or alleged breach of any of the warranties, representations or agreements of entrant hereunder. Any minor (for these purposes, a person under 18 years of age or under the age of majority in such person's state of residency) who appears in a Video Entry must receive his/her parent/legal guardian's permission and include his/her parent's/legal guardian's name and daytime telephone number on the third party consent and release form. Failure by an entrant to comply with any of the above representations and warranties shall render his or her Video Entry void. In the event Sponsor or any Releasee receives a bona fide claim concerning a Video Entry, as determined by Sponsor in Sponsor's sole discretion, that has been posted on CBS.com, such Video Entry will be disqualified and removed from CBS.com
6) ELIGIBILITY: Contest is open only to United States citizens residing in one of the fifty (50) United States and the District of Columbia, 18 years of age an older. Employees and their immediate families (spouse, parents, children, siblings, and their respective spouses), including those living in the employees' households of CBS Broadcasting Inc., SEG, Inc., Survivor Productions, LLC, their parent companies, affiliates, subsidiaries, divisions, advertising and promotion agencies, and Marden-Kane, Inc. are not eligible to enter. Members of SAG/AFTRA or any professionals from the film, television or video trades are not eligible to participate in the Contest. Contest must be entered from one of the fifty (50) United States or the District of Columbia. Void in Puerto Rico and all other U.S. territories and possessions and where prohibited.
7) PRIZES: One (1) Weekly Prize per Week for ten (10) weeks: "Survivor: Borneo - The Complete Season" on DVD. Retail value $44.99. Survivor series chosen for Weekly Prize is at discretion of Sponsor. One (1) Grand Prize: A Sony Video Package. Prize consists of a Sony TV, Camcorder and DVD Player. Models selected at discretion of Sponsor. Approximate retail value $3,500. Total value of all prizes to be awarded is $3,949.90. All other costs not specifically stated herein as being awarded are the responsibility of the winner. Prizes are non-transferable and no substitutions/cash equivalent permitted, except in Sponsor's sole discretion. If the any winner is a minor in his/her state of residency, the prize shall be awarded in the name of such winner's parent/legal guardian. All taxes and other costs associated with prize not stated herein as being awarded are the sole responsibility of the winners.
8) NOTIFICATION: Weekly Finalists may, at the discretion of the Sponsor, be notified by telephone, e-mail and/or mail. Weekly Winners and the grand prize winner may be required to submit additional documents relating to their Video Entry and completed forms, eligibility or prize awarded in this contest and return such documents properly executed within the time period noted by the Sponsor. Failure to return documents as specified, or if any notification is returned as undeliverable, will result in disqualification of the Video Entry and an alternate winner may be named.
9) ADDITIONAL TERMS AND RESTRICTIONS: Any attempt by an entrant or any other individual or group to deliberately damage any online service or Web site, tamper with the voting process, or otherwise undermine the legitimate operation of the Contest is a violation of criminal and civil laws and should such an attempt be made, Sponsor reserves the right to seek damages and/or other remedies from any such person or group to the fullest extent permitted by law. Failure to enforce any term of these Official Rules shall not constitute a waiver of that provision. If for any reason the Contest is not capable of being executed as planned, or infection by computer virus, bugs, tampering, unauthorized intervention, fraud, action of entrants, technical failures or any other causes beyond the control of Sponsor, corrupts or affects the administration, security, fairness, integrity, or proper conduct of this Contest, the Sponsor reserves the right at its sole discretion to disqualify any suspect Video Entry or entrant and to cancel, terminate, modify or suspend the Contest and/or award the prizes from among all eligible, non-suspect eligible Video Entries received as of the date of the termination, as Sponsor determines in its sole discretion. Video Entries not complying with all rules are subject to disqualification. Sponsor retains right to modify rules at any time, for any reason. No correspondence regarding entries will be entered into with entrants or others that may appear in a video entry.
10) OWNERSHIP OF ENTRIES: By entering this contest, each entrant unconditionally assigns and transfers to Sponsor all rights, title, and interest in and to his or her Video Entry, including, without limitation, the copyright therein. Sponsor shall have the right in perpetuity, in its sole discretion, to edit, composite, morph, scan, duplicate, or alter, the Video Entry for any purpose which Sponsor deems necessary or desirable. Each entrant and any persons appearing in a Video Entry agree that Sponsor may, without any limitation, use entrant's and/or any Video Entry participant's name, voice and/or likeness in any and all media now known or hereafter discovered for the purpose of advertising and promoting the Website, the Contest, the Survivor series or any other promotion, contest or sweepstakes sponsored by the Releasees. Neither entrants (or any Video Entry participant) nor winner shall be entitled to receive any compensation or credit for any use of the Video Entry other than that disclosed in these Official Rules.
11) RELEASE: Neither Sponsor, CBS Broadcasting Inc, SEG, Inc., Survivor Productions, LLC their respective parent companies, affiliates, subsidiaries, divisions, advertising and promotion agencies, including Marden-Kane, Inc., and their respective officers, directors, shareholders and employees (collectively "Releasees") nor any telephone network or Internet service providers shall have liability and shall be held harmless for any damage, loss or injury to a winner or any third party resulting from participation in this Contest or for the use or misuse of any prize; nor for incorrect or inaccurate transcription of entry information, or for any human or other error, technical malfunctions, lost/delayed data transmission, omission, interruption, deletion, defect, line failures of any telephone network, computer equipment, software, inability to access any online service or web site, or any other error or malfunction, or any injury or damage to participant's or any other person's computer related to or resulting from participation in this Contest, or for any injury to person or property, including but not limited to video equipment, arising from the entrant's participation in this Contest or any Contest-related activity or from the acceptance, receipt, possession, use or misuse of any prize won. Releasees are not responsible for lost, late, illegible or misdirected entries or mail.
12) WINNERS LIST: For the names of the winners, available after 5/31/05, send a self-addressed, stamped envelope by 7/15/05 to: Survivor Video Contest, c/o Marden-Kane, Inc., 36 Maple Place, Manhasset, NY 11030-1962.
13) SPONSOR AND ADMINISTRATOR: The Sponsor of this contest is: CBS.com, a unit of CBS Broadcasting Inc., 51 West 52nd Street, New York, New York 10019. The administrator of this contest is Marden-Kane, Inc., 36 Maple Place, Manhasset, NY 11030-1962.
